Purchase of property

If you are considering purchasing property, contact us to arrange a review of the Section 32 Vendor’s Statement and Contract of Sale prior to signing. This way, we can advise you on any potential issues or matters that should be investigated further before proceeding. We can also advise on the purchasing entity most suitable to your circumstances, including the manner of holding where more than one purchaser is involved. Once the Contract of Sale is signed, we will manage the conveyancing process and keep in contact with you through to settlement.

Caveats

We can lodge and withdraw caveats on your behalf. A caveat is a warning to anyone searching a Title that the caveator (the person who lodged the caveat) has an interest in the property.

When acting for you in a purchase of property, we will provide advice on the benefits of lodging a caveat to protect your interest as purchaser of the property between signing of the contract and settlement.

Lease Agreements (Commercial and Retail) and Licences

NextGen Legal can review existing leases or new lease arrangements and provide advice prior to signing.

We can prepare both commercial and retail leases including disclosure statements, transfers of lease, variation of lease and renewal and surrender of lease when required.

We also prepare licences for short-term occupation, particularly in conveyancing transactions where either the vendor remains in the property for a short period after settlement or the purchaser takes occupation of the property prior to settlement. Mortgages If you wish to register a private mortgage over a property in order to protect your interest as Mortgagee, NextGen Legal can assist with the preparation, signing and subsequent lodgement of the mortgage at the Land Titles Office.

Powers of Attorney

If you will be away for a period of time or unable to sign conveyancing documents, we can prepare and arrange for you to sign a Power of Attorney in line with your circumstances and specific requirements to enable the conveyancing process to continue in your absence.

Subdivisions including Off-the-Plan Sales and Purchases

This includes preparing off-the-plan contracts and lodging and registering the plan of subdivision Application.

Transfers of Title

  • Transferring property to an Executor in terms of a deceased person’s Will.
  • A relationship breakdown that requires one party to transfer to the other in a property settlement.
